How to file a case for the defamation?


Suppose someone is making a nasty remark to you about the people, who is misbehaving. You're defenseless. Now think, you will take legal action. But do not know how to get legal remedies. In this case some things are noteworthy.

Criminal and civil cases can be filed for defamation. The criminal court has to file a case of defamation suit. He may issue a summons against the person accused of hearing the complaint. However, a direct arrest warrant was not issued in defamation case. If a person does not appear before the court after the summon, then the judge can issue a warrant.

The 499 section of the Penal Code will defame what is and what will not be done. In accordance with this section, knowing that such person is intended to destroy another person's fame or reputation, or if he prepares or exposes a person with such intentional words or traces or with a visible symbol, then he will be deemed to have defamed the person. Even talking about a dead person will be defamatory. Relatives of the deceased can bring defamation charges. 4. Reports of court proceedings will not include defamation.

5. Disagreeing about any public opinion and honest beliefs about the conduct of a person is not a defamation.

6. The opinion about the fault, quality or the witnesses or the behavior of other relevant people in the court will not fall into defamation.

7. There is no defamation in giving any opinion about public events.

8. Complaining about someone with authority in person will not be defamated. For example: The police complain about somebody's honest beliefs.

9. It is not defamation for any person to blame for the protection of his or her interests.

10. There will be no defamation if somebody is asked to warn about public welfare.

In the statement of defamation of section 500, it has been said that if convicted of this crime, there can be two years' imprisonment for imprisonment or a fine or both.

On the other hand, according to the 501 and 502 of the Penal Code, the scandal is known about printing or carving and its punishment is known.
